NEW YORK—In what police say is a case of mistaken identity, Robert Correia, 20, of Cape Cod, Mass. was arrested yesterday after allegedly beating up someone who he thought was a Yankees fan with a baseball bat.
Correia was charged in Falmouth (Mass.) District Court with assault and battery with a dangerous weapon and malicious damage to a motor vehicle. He was held without bail.
The incident happened on Saturday after a late Fourth of July fireworks display in Falmouth. A car driven by the victim William Nestor of Northport, N.Y. was approached by Correia and a few other men. Police say Correia and the men approached Nestor because of his New York license plates. Nestor heard Correia yell, "F*** New York" and "F*** Yankees," and subsequently confronted the men. Correia then went back to his nearby apartment to retrieve a baseball bat, came back, and struck Nestor.
Correia and his lawyer shared a different story. Correia's lawyer said that he was in his apartment when he witnessed a fight outside, and Correia went outside to break up the fight with a baseball bat. Correia only swung his bat when Nestor charged at him, said his lawyer.
Nestor was treated at and released from Falmouth Hospital after the attack. In response to claims that he was attacked because he was a Yankees fan, he replied that he wasn't a big baseball or Yankees fan at all.
